In these Terms and Conditions, the following words shall have the following meanings:

“Company” Means trading as Fulbridge Training part of Fulbridge Social Care Ltd

“Intellectual Property” Means copyright and other intellectual property rights found on this website

“Fulbridge Training website” Means the company website www.fulbridgetraining.co.uk

“Personal Data” Has the meaning as more particularly defined in the Data Protection Act 1998

“Profile Information” Means the information provided by a candidate including (without limitation) name, email address, company and contact details.

1. Use of material

1.1 You can download, print and copy material from the Fulbridge Training Website for your own personal use. You must not reproduce any part of the Fulbridge Social Care Website or its material unless the Company have granted you permission to do so.

2. Disclaimer of liability

2.1 To the extent permitted by law and subject to clause 10.1 the Company accepts no responsibility for the content of advertising material, including, (without limitation), any error, omission or inaccuracy there in.

2.2 To the extent permitted by law and subject to clause 10.1 the Company does not warrant that:

2.4 The provision of any of the services of the Company will be uninterrupted or error-free.

3. Accessing external websites

3.1 You can access other sites via links from the Fulbridge Training Website. These sites are not under the control of the Company, and the Company accepts no responsibility for any content on such sites or for any use to which they put any personal or confidential information provided by you.

4. Registering an account

4.1 If you register for an account on the Fulbridge Training Website, you will be required to provide:

  • Forename
  • Surname
  • Address
  • Email address
  • Company (if applicable)
  • Password

Personal Information is only used in order to create an individual user account for users to access our courses on the Fulbridge Training website only.

The Company is committed to ensuring your privacy is protected. This information will only ever be used by the Company. The Company will not contact you other than to send you, information about new courses bulletins, renewals and deals, you have subscribed to internal news about the Company’s services and offers. The Company will not distribute any of the details including the email address you provide to a third party. The Company have put in place suitable security procedures to safeguard your information.

If you wish to be removed from our system then this request needs to be done via email to training@fulbridgesocialcare.co.uk. Information will be removed within 48 hours unless the user has an account with a uncompleted course in which case the account and information will be removed once the account has no pending or incomplete training courses.

4.2 Access to your members account on the Fulbridge Training Website is via users:

  • Email address
  • Password

So please keep your password safe and do not disclose it to anyone else.

4.3 Any registration details you use must be personal to you and must not be used by anyone else.

4.4 You must not maliciously create additional accounts on the Fulbridge Training Website.

4.5 If, for any reason, the Company believes that you have not complied with these terms and conditions, or are misusing your Fulbridge Training Website account in anyway, the Company may, at its discretion, cancel, suspend or otherwise restrict your access to your Fulbridge Training website account immediately and without giving any advance notice.

5. Contract if Formed

5.1 After setting up an account and placing an order for an individual course, the user will receive an e-mail receipt stating the purchase price, your name and the course purchased. You can then access and undertake your purchased course whereby all training information will be provided along with the stipulations of passing the test.

Once you have passed your test, a course certificate will be automatically forwarded to you which will have on it, your name, course title, accreditation certificate, date undertaken and a statement outlining renewal date.

6. Online Training (Digital Content) – Refund

6.1 In the event that a Consumer purchases Digital Content and seeks to cancel within 14 working days (commencing the day after purchase) and seek a refund then they may only do so provided that the media has not been downloaded, accessed or streamed within the 14 day cooling period.

6.2 You cannot request a refund for product if a course has been started, undertaken, completed or failed with the stipulated rules set at the beginning of your course before you start even if the cancellation period is still running.

7. Email Communications

7.1 Messages from the Company may be confidential. If you are not the intended recipient you should not copy or disclose any message to anyone but should kindly notify the sender and delete the message.

7.2 Opinions, conclusions and other information in any message that do not relate to the official business of the Company or the Fulbridge Training Website shall be understood as neither given nor endorsed by it.

7.3 The Company accepts no responsibility for viruses and it is the recipient’s responsibility to scan any email and any attachments.

7.4 The Company reserves the right to access and disclose all messages sent over its email system.

8. Issues

8.1 If you experience any problems with the Fulbridge Training Website or wish to make a complaint about the Fulbridge Training Website, any of the services available on the Fulbridge Training Website provide then please contact us immediately via email or telephone.

8.2 To the extent permitted by law and subject to clause 10.1 the Company does not accept any liability for any delay or disruption that you may experience whilst using any aspect of the Fulbridge Training Website or for any loss or damage to your account.

8.3 The Company do not guarantee the continued and uninterrupted availability of any aspect of the Fulbridge Training Website and to the extent permitted by law and subject to clause 10.1 the Company accepts no liability for any unavailability including without limitation due to technical errors or faults.

8.4 The Company is concerned for the privacy of visitors and registered users of the Fulbridge Training Website. The protection of your personal information is extremely important to us. However, please remember that the security of information transmitted over the Internet cannot be assured.

9. Liability

9.1 Nothing in these Terms and Conditions will exclude or limit the Company’s liability to you for fraud or statements made fraudulently; or for death or personal injury caused by the Company’s negligence, or for any other liability which cannot be excluded or limited under applicable law.

10. Data Protection Act 1998

10.1 The Fulbridge Training Website is operated by the Company. For the purposes of the Data Protection Act 1998, the Company is the “data controller” in respect of personal information that we obtain from you via the Fulbridge Training Website.

10.2 The website of the Information Commissioner’s Office provides information and assistance with regard to your rights under the Data Protection Act 1998 and related legislation (www.ico.gov.uk).

10.3 To the extent permitted by law and subject to clause 11.1 the Company and their respective staff accept no responsibility for any use which is made of the Materials and shall not be liable to any person for any direct or indirect loss or damage, including (without limitation) loss of profits, loss of revenue, loss of data or any third party claims which may arise from the use of the Materials.

11. Training

11.1 The term ‘Fulbridge Training or ‘us’ or ‘we’ refers to the owner of the website whose registered office is Fulbridge Social Care, 2 Fulbridge Road, Peterborough PE1 3LA .

12. Courses

12.1 Accredited courses on our website are accredited by CPT Ltd www.cpduk.co.uk

12.2 Courses will be updated accordingly in relation to legislation changes and all courses will be overviewed monthly by our training department.

13. General

13.1 Notwithstanding that any terms may prove to be illegal or unenforceable, the remaining Terms and Conditions of this Agreement shall continue in full force and effect.

13.2 Except as expressly set out in these terms, nothing in these Terms and Conditions shall confer on any third party any benefit or the right to enforce any provisions of this Agreement.

13.3 The Terms and Conditions and Privacy Policy constitute the whole agreement between you and us relating to this subject matter and supersede all prior arrangements or promises between you and us relating to this subject matter. Nothing in this clause shall limit or exclude any liability for fraud.

13.4 These Terms and Conditions shall be governed by and construed in accordance with English Law and you and the Company hereby submit to the non-exclusive jurisdiction of the English and Welsh Courts.

14. Variation

14.1 We have the right to revise and amend these Terms and Conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.
